Please read these Terms and Conditions carefully as they contain important information about your legal rights, remedies and obligations. From the confirmation of the reservation, that is, from the time the deposit has been sent, you agree to comply to these Terms and Conditions. 

Holiday rentals of Apartments, Studios, Houses, Duplexes and Chalets 

The SAN JOSE SPAIN website (https://www.sanjosespain.com) makes available to all its clients a calendar system to easily see the availability of the various accommodations advertised here and the system could suffer failures or involuntary technical errors in the reservations. Therefore, a reservation cannot be considered valid until you receive a confirmation message from the agency. No reservation will be considered valid until the payment of the deposit (30% of the total price of the reservation). 

The rental price includes electricity, bed linen and bath and hand towels, but not beach/pool towels. If you require extra items such as a cot, highchair for children, etc., we ask that you inform us when making the reservation. These items have an extra charge, and we will tell you the total amount when you make your reservation. 

The price includes the cleaning of the property at your arrival. We ask you to leave the property as you found it. Otherwise, we will be forced to withhold 30,- € from your deposit. 

Check-In and Check-Out of the accommodation 

The entrance to the accommodation will be made on the day agreed in the reservation confirmation from 5:00 p.m. to 9:00 p.m. If the arrival occurs after 9:00 p.m., SAN JOSE SPAIN reserves the right to charge the amount of €15 per hour of delay as “Late Check-In”. In the cases in which it is requested to enter before 5:00 p.m., confirmation by SAN JOSE SPAIN will be necessary and organizational reasons and availability of the contracted accommodation will always be taken into account. 

The day of departure will also be the one stipulated in the reservation and will take place before 10:00 a.m. For departures after 10:00 a.m., confirmation from SAN JOSE SPAIN will be required, if the accommodation is available. 

The house must be left after the guest’s departure as it was found on the day of arrival, without garbage and closed. Our agents will see you off at the agreed time, collect the keys and return the deposit. 

On the day of arrival, the traveller registration required by law will be carried out for all guests, being necessary the presentation of the valid ID or passport for all those over 16 years of age. The keys will be handed over to you and you will receive tourist information and maps of the area via a QR code. If a bank transfer has not been made, then the total payment of the reservation will be made in cash, discounting the prepayment of the deposit collected for confirmation. It will also be necessary to deliver a deposit in cash as a guarantee, said amount will be agreed upon in the reservation confirmation and will be proportional to the type of accommodation and its characteristics, as well as the presence of pets, if applicable, number of guests and total nights reserved. This deposit will be used exclusively to correct possible damages caused by the misuse of the facilities and elements that compose it, loss of keys, lack of cleaning, accumulation of garbage, both in the interior and exterior areas of the house in each case. The house must be left after the departure of the guest as it was found on the day of arrival. The above-named deposit will be returned after supervision of its facilities in cash at the time of departure from the accommodation.  

The total number of people staying may not be greater than that stipulated in the reservation and under no circumstances will it be greater than the accommodation capacity of the contracted accommodation, as established by law. Any excess in this number at the time of arrival or later entitles SAN JOSE SPAIN to immediately terminate the contract without any compensation to the lessee. 

The assignment or subletting of the property or the assignment of the reservation to a third party other than the one signing this contract is expressly prohibited.  

CONDITIONS AND RULES OF PETS 

Dogs are allowed in some types of accommodation and written confirmation from SAN JOSE SPAIN will always be required at the time of making the reservation. Only one dog of up to 20 kg is allowed per accommodation or 2 dogs of up to a maximum of 5 kilos each. Other types of pets are not allowed, please consult our agents if you have any questions or requests about it. €20 per dog and reservation will be charged for “extra cleaning per pet” to be paid on the day of arrival. It is the client’s responsibility to ensure the safety of the animal and the home, it is also totally forbidden to leave the animal alone in the accommodation and without supervision. Also having to respect other tenants and/or adjoining neighbours in a matter of noise and bad odors that could originate. In addition, it is totally prohibited in accommodations with common areas for dogs to run loose in said areas, and the conditions and rules regarding pets of each neighbouring community in question must be respected. 

The good use of the facilities 

SAN JOSE SPAIN is not responsible for situations unrelated to the accommodation, such as external noise, works outside the home, interruptions or temporary cuts in the accommodation supplies, and other similar causes, that are not attributable to the property. 

If the reserved accommodation has a swimming pool, terrace, balcony, common areas, both private and community gardens or any other facilities attached to the leased home, SAN JOSE SPAIN will not be responsible for accidents that may arise in particular in regarding their security and surveillance. 

The use of said facilities is the sole responsibility of the lessee client. 

Committing that neither you nor the other persons who make up this rental agreement will make disproportionate or vandalistic use of the installation or use it while intoxicated or under the influence of psychotropic substances that alter your physical and mental condition, which compromises your integrity, as also jeopardize the integrity of third parties unrelated to this document or cause inconvenience or confrontation with other users of these facilities. 

Property insurance does not cover your belongings. 

The use of radios or any other musical device, instrument or object that generates noise must not cause inconvenience to the rest of the neighbourhood, their use and volume should be limited to common sense if the quiet times of their neighbours are respected. In this context, it should be avoided between 11:00 p.m. and 10:00 a.m., the night rest, and between 3:00 p.m. and 5:00 p.m., the siesta time. 

Responsible Consumption and the Environment 

The team that makes up SAN JOSE SPAIN and all its collaborators are very aware of the environment; we live in a geographical area with special environmental protection, and we are very aware of the importance of preserving the natural paradise in which we find ourselves. Respect for nature, the sustainable use of resources and the low overcrowding of our coasts are not only hallmarks of the Natural Park Cabo de Gata-Níjar, but also its inhabitants and all who visit us. Remember that you are in a maritime-terrestrial park that is also included in the European Geoparks network, so we invite you to be part of this environment and respect it as it deserves. 

Please be aware of the place where you come to enjoy your vacations, make responsible use of the electricity and water you consume. Do not leave light bulbs on when not in use, put the washing machine on a full load, respect the capacity of the refrigerator and freezer, do not leave the air conditioning on when you are not in the house or in any room of the house and close the windows when it is on, keep the air conditioning temperature stable between 24 and 26 degrees, ventilate the house every morning, make use of the parasols, awnings and blinds available in each case, take a shower instead of a bath, separate the garbage, etc. These are just examples that you can do to give back to nature all that it has to offer.

General conditions for formalizing the reservation 

To confirm the reservation, a reservation deposit of 30% of the total agreed amount will be required, which may be paid by bank transfer. 

The remaining amount plus the supplements applicable to pets, extra cleaning, extra beds, cots or any other supplement of this nature applicable to the reservation, will be made on the day of arrival before handing over the keys to the accommodation. It can be done in advance by bank transfer or on the day of arrival in cash. 

In addition, it will be necessary to pay the indicated deposit, as mentioned above. After the collection, the contract, and the document on the Protection of personal data will be signed by the person who adheres to this contract. To comply with the regulations, guests of tourist rentals are registered at the Guardia Civil. 

Cancellation and/or modification policy 

Our cancellation and/or modification policy allows you to modify your reservation before the arrival date. In the event of a cancellation, SAN JOSE SPAIN will invoice you for the deposit made by you at the time of confirmation of the reservation as “Cancellation of the reservation”. 

Remember that in the case of modifications in the dates, the written confirmation by SAN JOSE SPAIN will always be considered, based on the availability of our accommodations. In addition, variations in the rates may arise or decrease due to changes in the seasonal rates and/or demand in each specific case. For more information consult our agents 

If you do not show up on the day of arrival, you will be charged the amount paid for the reservation as a “No Show”.  

We recommend that you make sure at the time of booking that your travel insurance covers you in case of cancellation. 

Breach of conditions 

Consequences of not complying with the provisions: SAN JOSE SPAIN reserves the right to send notice to the relevant authorities to vacate the property after corroborating the facts. Therefore, we ask all our guests to respect the environment in which they find themselves and enjoy with common sense both the facilities of SAN JOSE SPAIN and the Natural Park in which they are located, allowing their own rest and that of others. 

Non-compliance will also imply immediate eviction from the home, the loss of the total amount deposited as a “damage bond”. The application of this clause does not imply possible legal actions that third parties unrelated to this document may take in defence of their rights.
